Announcement on the decision for suspension of work at Votanikos
Following the decision of the Committee of Suspensions of the Council of State on the 19/1/2009, BVIC S.A. announces:
The three members Committee of Suspensions of the Council of State decided in favour of the suspension of construction works of the Votanikos shopping mall (land plot 45a of the municipality of Athens, on Aghiou Polycarpou and Aghia Anna Str).
According to the applicable legislation as well as the reasoning given by the decision, when there are issues of public interest, the request for a suspension to execute the affected act will not be accepted. The President's minority opinion was that '..there are issues of urgent public interest in this case, concerning as much the realization of urban regeneration in the area of Votanikos as well in land plot 22 area 69 of the Municipality of Athens (Ampelokipi), as from the commonly known economic and social consequences that will rise from prevention of the urban regeneration, reasons that constitute issues of critical public interest and prevent the issuance of a suspension to execute the affected acts. This is because the existence of issues of critical public interest on its own, as in the current case, is sufficient to prevent the issuance of suspension to execute the affected acts'.
Following the above mentioned, as well as new facts arising and supporting our case, the company will submit an appeal for the retraction of the decision of suspension. This appeal will make clear the issues of critical public interest that arise, both because of the cancellation of the joint redevelopment as well as the socio-economic consequences that will rise.
