OPAP'S ANNOUNCEMENT REGARDING EU COURT OF JUSTICE JUDGMENT


OPAP welcomes EU Court of Justice judgment of 21 December 2016, in case C-131/15 P, confirming OPAP's and European Commission's position with regard to the legality of its exclusive rights and in particular its exclusive licence to operate 35,000 Video Lottery Terminals.

In 2012, the European Commission decided that OPAP paid an adequate consideration for the exclusive licence to operate 35,000 Video Lottery Terminals and the 10-year prolongation of the exclusive rights for the operation of 13 games of chance by any means. In particular the Commission held that the relevant agreements did not confer any undue advantage to OPAP.

In 2013, Greek casino operators brought an action before the EU General Court against the Commission's decision and in 2015, the EU General Court dismissed their action.

The Greek casinos brought yet another action against the EU General Court's judgment and on 21 December 2016 the EU Court of Justice dismissed their appeal. The Court of Justice rejected all pleas raised by the Greek casino operators and confirmed the judgment of the EU General Court and OPAP's position.
